Welcome to DriverNE. These Terms and Conditions (“Terms”) govern your use of our platform (website, mobile application) and the services offered by DriverNE (referred to as “Platform”). Please read these Terms carefully before accessing or using the Platform.

By accessing the Platform or using any services provided by DriverNE, you agree to be bound by these Terms.

1. Definitions

• "Applicable Law(s)" refers to all applicable statutes, enactments, acts of legislature or parliament, central or state laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives and orders of any governmental authority, tribunal, or a court of India.
• "Platform" refers to the DriverNE website, mobile application, and other related services.
• "Services" means the driver-on-demand service provided to users for personal or commercial use.
• "Users" refers to individuals who use the Platform.
• “City of Operation” shall mean a city in which DriverNE will be rendering services to different Users.
• "Drivers" refers to such individuals who are independent third party service providers engaged by or associated with DriverNE or its subsidiaries/affiliates, to provide transportation services to Users. They are persons who are registered with DriverNE after having represented to DriverNE that they have the necessary licences to provide transportation services within the City of Operation.

2. Eligibility

The Platform is available only to individuals who are 18 years or older and can form legally binding contracts under applicable law.

By registering on the Platform, you represent that you are at least 18 years old, and all information provided by you is accurate and truthful.

DriverNE reserves the right to terminate or restrict your access if it is discovered that you are underage or have provided false information.

3. Registration and Account

To use the Platform, you are required to create an account by providing accurate and complete information, including your name, email address, contact details, and payment information.

You agree to maintain the confidentiality of your account credentials and are responsible for all activities that occur under your account.

DriverNE is not liable for any loss or damage arising from your failure to maintain the confidentiality of your account information.

4. Services Provided

DriverNE connects Users with professional Drivers who can drive the Users' vehicles to specified destinations.

The Platform facilitates Users to book drivers for one-time or recurring services as per the availability of Drivers in their location.

DriverNE only acts as an intermediary, and the actual service is provided by independent Drivers.

The availability of Drivers and the execution of services are subject to driver availability and external conditions.

5. Disclaimers

DriverNE, through its platform, facilitates the hiring of independent drivers by users for private point-to-point or round-trip driving services, both within and outside city limits. The application provides a mechanism for users to request such services and connect with drivers. By using the platform, you, as a user, expressly authorize the selected driver to operate your vehicle and make necessary driving-related decisions on your behalf for the duration agreed upon.

It is explicitly clarified that DriverNE does not provide driving or transportation services and does not supply any means of transportation. Users are required to provide their own vehicles for the service. DriverNE acts solely as a mediator, enabling users to connect with drivers. The provision of driving services by the driver is governed by a separate agreement entered into directly between the user and the driver. Under no circumstances shall Drive NE be deemed a party to such agreements.

DriverNE expressly disclaims all liability for the actions or omissions of drivers, including any claims related to employment or vicarious liability. The user acknowledges and agrees that the use of the services facilitated by DriverNE is entirely at their own risk and that any contractual terms or disputes regarding the services rendered by the driver are outside the purview of DriverNE's responsibilities.

6. User Responsibilities

• Users are responsible for ensuring that their vehicles are safe, roadworthy, and insured before booking a Driver through the Platform.
• Users must provide accurate information about the pickup location, destination, and any specific instructions for the service.
• Users must treat the Drivers with respect and comply with all traffic laws during the service.
• Inappropriate behaviour or illegal activities during the service will result in the termination of the account and possible legal action.
• Users are strictly prohibited from accessing the DriverNE service or application using unlicensed, incompatible, or unauthorised devices. DriverNE reserves the right to suspend or terminate service and access to the application or website for such violations.
• By using the DriverNE platform, you confirm, represent, and warrant that you are legally permitted to own and operate the vehicle and that the vehicle is in good working condition and complies with all applicable safety standards and motor vehicle laws.
• You acknowledge that all liabilities arising from the state of your vehicle, including but not limited to personal injury, wrongful death, and property damage, are solely your responsibility. If your vehicle malfunctions during the use of DriverNE services, you will bear all costs associated with storage, roadside assistance, alternative transportation, and any necessary repairs. DriverNE and the driver shall bear no responsibility for any such issues.
• As a user, you warrant that you have the legal authority to designate the driver as your representative and to grant them the actual authority to operate your vehicle and make decisions on your behalf for the duration of the services.
• As a user, you warrant that you are named or scheduled on a valid insurance policy that covers the operation of your vehicle and meets all applicable legal requirements, including liability coverage sufficient to address any losses arising from the services or the operation of your vehicle by the driver.
• In the event of a motor vehicle collision, you are solely responsible for notifying your insurance provider and adhering to all applicable statutory and regulatory requirements, including those of the relevant motor vehicle department.
• You assume full responsibility for all outcomes arising from the use of the services or the driver’s actions, except for any personal criminal liability of the driver. DriverNE disclaims all liability related to such matters and will not be held responsible in any capacity.
• If a driver operates your vehicle for more than five hours continuously, you agree to provide a meal or reimburse the driver for the cost of a meal during the service.

7. Payment Terms

• Users shall pay the fees as indicated on the Platform for the services rendered by Drivers.
• Payment can be made through third-party payment processors integrated into the Platform. DriverNE is not responsible for any errors or delays in processing payments.
• If the service is cancelled after a Driver has been assigned, a cancellation fee may apply as indicated on the Platform.
• Refunds, if any, will be processed according to DriverNE’s refund policy.

8. Driver Responsibilities

• The Driver shall at all times possess a valid driver’s licence and any other required permits or documents as per Applicable Laws. The Driver is responsible for ensuring that these documents remain valid and up to date.
• Drivers must follow all applicable traffic laws, maintain professionalism, and ensure the safety of the vehicle and passengers during the service.
• Drivers are prohibited from engaging in any illegal activities during the service and must maintain a clean driving record.
• Drivers have the right to refuse service if they feel unsafe or if the vehicle is not in a proper condition to be driven.
• The Driver shall maintain the Vehicle in a roadworthy condition, ensuring it is clean, safe, and meets all regulatory requirements for passenger transportation.
• The Driver agrees to take full responsibility for the Vehicle and shall return it in good condition to the User upon completion of a trip.
• The Drivers shall comply with the operational guidelines, safety standards, and terms set by DriverNE and must adhere to all applicable laws and regulations governing transportation services.
• The Driver acknowledges and agrees that the Vehicle provided by the User is strictly for the purpose of conducting transportation services as directed by the User. The Driver shall not, under any circumstances, use the Vehicle for personal errands, transportation of non-service-related passengers, or any activities unrelated to the transportation services.

9. Cancellation Policy

Users can cancel bookings through the Platform before the Driver is dispatched. However, if a Driver has already been dispatched, cancellation fees may apply.

DriverNE reserves the right to cancel any booking at its discretion, including but not limited to cases where the vehicle is deemed unsafe or when the User violates the Terms.

10. Relationship

The drivers listed on the DriverNE platform are private individuals or independent service providers who have voluntarily registered with the platform and have successfully completed a verification process. It is expressly clarified and agreed that the drivers operate as independent contractors and are not employees, agents, or representatives of DriverNE. Accordingly, drivers shall not, at any time, represent or claim to be employees of DriverNE.

11. Liability & Indemnification

• DriverNE is not responsible for any direct or indirect damages, losses, or injuries that occur during the use of its services. This includes, but is not limited to, accidents, vehicle damage, delays, or unforeseen circumstances.
• DriverNE does not provide insurance for the vehicle or passengers during the service. Users must ensure their vehicles are adequately insured.
• Users agree to indemnify and hold DriverNE, its affiliates, and its employees harmless from any claims, damages, liabilities, costs, or expenses arising from the use of the Platform or violation of these Terms.

12. Intellectual Property

All content, trademarks, and intellectual property displayed on the Platform are owned by DriverNE or its licensors. Users may not use, reproduce, or distribute any content from the Platform without written permission from DriverNE.

13. Privacy

DriverNE collects and processes Users’ personal data in accordance with its Privacy Policy. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.

14. Termination

DriverNE reserves the right to suspend or terminate your access to the Platform at any time for any reason, including violation of these Terms.

Upon termination, your right to use the Platform ceases immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Guwahati, Assam.
