This Driver Onboarding Agreement (the “Agreement”) is effective from the date of the driver's registration on the DriverNE platform. Please read the Agreement carefully before accessing or using the Platform.

1. Scope of Engagement

  • 1.1 DriverNE operates a platform that connects users with independent drivers to provide professional driving services using the user’s vehicles. By onboarding with Driver NE, you agree to act as an independent contractor providing these services.
  • 1.2 Drivers are responsible for operating customer-owned vehicles to designated destinations, following the instructions provided through the platform.
  • 1.3 DriverNE serves solely as a mediator between drivers and users, facilitating the connection through its platform. DriverNE does not provide transportation services or own vehicles for hire.

2. Driver Obligations

Drivers are required to fulfil the following obligations while operating under the DriverNE platform:

  • 2.1.1 Refrain from consuming or carrying Gutka or any substances that may emit an unpleasant odour in the vehicle.
  • 2.1.2 Avoid actions such as bending down seats or sleeping in the vehicle during the trip.
  • 2.1.3 Drive quietly and professionally, ensuring a peaceful environment for the customer.
  • 2.1.4 Arrive at the designated pickup location before the scheduled time.
  • 2.1.5 Avoid last-minute cancellations. Drivers who cancel bookings without valid reasons may face penalties, including restrictions on receiving future bookings.
  • 2.1.6 Inspect the vehicle before starting a trip, including checking tyres, oil, battery, and other essential components.
  • 2.1.7 Maintain the vehicle in a roadworthy condition during the trip and promptly report any issues to DriverNE.
  • 2.1.8 Refrain from making personal phone calls during the trip, except in emergencies.
  • 2.1.9 Direct all complaints, concerns, or operational issues to DriverNE, avoiding communication of problems to customers.
  • 2.1.10 Avoid asking customers for additional money under any circumstances.
  • 2.1.11 Always inquire about the customer’s comfort regarding vehicle speed and adjust accordingly.
  • 2.1.12 Remain near the vehicle when parked and assist the customer as needed.
  • 2.1.13 Open the car door for the customer as a courtesy.
  • 2.1.14 Drivers must not contact customers directly to cancel bookings. All cancellations must be processed through DriverNE.

3. Relationship with DriverNE

  • 3.1 Drivers are independent contractors and not employees, agents, or representatives of DriverNE.
  • 3.2 Drivers acknowledge that DriverNE is not a party to the agreement between the driver and the customer for services rendered.
  • 3.3 Drivers shall not represent themselves as employees or agents of DriverNE at any time.

4. Driver Fee

  • 4.1 Drivers will earn fees as determined by the platform’s pricing structure, subject to applicable deductions.
  • 4.2 Payments will be processed regularly through bank transfers to the account provided during onboarding.
  • 4.3 In the event that a Driver fails to remit the commission within three (3) working days from the due date, the Driver’s account will be automatically blocked from accessing the application. The Driver will not be able to use the application’s services until the outstanding commission is paid in full and the account is reactivated as per the company's policies.

5. Confidentiality and Data Usage

  • 5.1 Drivers agree to maintain confidentiality regarding any proprietary information shared by DriverNE.
  • 5.2 DriverNE may use driver data in accordance with applicable laws for operational purposes, including background verification and analytics.

6. Insurance and Liability

  • 6.1 Drivers must ensure that customer vehicles meet all safety and legal requirements before service.
  • 6.2 Drivers shall not hold DriverNE liable for any claims arising from vehicle malfunction, customer disputes, or accidents during service.
  • 6.3 Drivers must not represent DriverNE as responsible for vehicle operation or passenger-related issues.

7. Compliance with Code of Conduct

Drivers are required to comply with the DriverNE Code of Conduct, which includes the following:

  • 7.1.1 Refrain from consuming substances that create unpleasant odours in the vehicle.
  • 7.1.2 Avoid bending down seats or sleeping in the vehicle.
  • 7.1.3 Check vehicle components, including tyres, oil, and battery, before commencing trips.
  • 7.1.4 Do not make personal phone calls during trips.
  • 7.1.5 Always remain professional and courteous to customers.
  • 7.1.6 Avoid asking customers for additional money or disclosing operational issues.
  • 7.2 Failure to adhere to the Code of Conduct may result in disciplinary action, including suspension or termination from the platform.

8. Termination

  • 8.1 DriverNE reserves the right to terminate this Agreement for non-compliance, misconduct, or violation of applicable laws.
  • 8.2 Upon termination, drivers must return any property or information provided by DriverNE and cease operating under its platform.

9. Indemnity

The Driver agrees to indemnify, defend, and hold harmless DriverNE, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • 9.1.1 Any breach of the terms and conditions of this Agreement by the Driver.
  • 9.1.2 Any acts, omissions, or negligence by the Driver in connection with the performance of services under this Agreement.
  • 9.1.3 Any third-party claims, including but not limited to claims of personal injury, property damage, or violations of applicable laws, arising from the Driver's actions or omissions during the provision of services.
  • 9.1.4 Any fines, penalties, or legal consequences resulting from the Driver's failure to maintain valid licences, permits, or documentation as required by law.
  • 9.1.5 Any misuse, unauthorised use, or unsafe handling of customer vehicles during service.

10. Limitation of Liability

  • 10.1 DriverNE shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, revenue, or data, arising out of or in connection with this Agreement, even if advised of the possibility of such damages.
  • 10.1.1 DriverNE's liability under this Agreement, regardless of the cause of action, whether in contract, tort, or otherwise, shall not exceed the total amount of fees paid to the Driver by Driver NE for the services rendered in the six months preceding the claim.
  • 10.1.2 DriverNE shall not be liable for any loss or damage caused to the Driver as a result of - a) the customer’s non-compliance with the terms of service; b) vehicle malfunction or issues beyond DriverNE's control c) delays, cancellations, or other operational disruptions.
  • 10.1.3 DriverNE disclaims all liability for disputes arising between the Driver and the customer, including but not limited to disagreements over service quality, fees, or vehicle condition.

11. Governing Law and Dispute Resolution

11.1 This Agreement shall be governed by the laws of India. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Guwahati, Assam.

12. Acceptance

By registering on the DriverNE platform, you confirm your understanding and acceptance of the terms of this Agreement, including all responsibilities and obligations outlined herein.
